Gunselman appeared before a federal magistrate in San Antonio on Tuesday for a hearing to determine whether or not he could be released.
That judge granted his release but federal prosecutors immediately appealed that decision to Federal District Court Judge Sam Cummings, who sits in Lubbock.
Cummings granted the government's order.
It remained unclear Tuesday night whether or not Gunselman would be transferred to a Lubbock holding facility.
Gunselman was represented at the hearing by Dan Cogdell, a high-profile lawyer from Houston.
Cogdell recently represented now-convicted terrorist Khalid Aldawsari at his federal trial last month.
A phone call and e-mail to Cogdell late Tuesday afternoon went unanswered.
