Family of Wrongly Convicted Man Confronts Former Prosecutor

           It's been nearly a week since a former Texas Tech student became the first Texan ever cleared of a crime after his death. On Thursday, the family of the late Timothy Cole came to Lubbock to speak with the man who prosecuted him more than two decades ago. Last Friday, an Austin Judge officially exonerated Cole of raping a fellow Tech student in 1985. DNA evidence proved Cole was innocent, but he had died in prison in 1999. District Judge Jim Bob Darnell was the District Attorney in 1985, and today he sat down with Cole's family. 

Cory Session, Cole's younger brother says, "I told Judge Darnell, I hope this gives you and your fellow judges a different perspective on people in your court ... If someone says they're innocent, they just might be innocent. Take another look at it and quit trying to put everyone behind bars to put a another notch on your belt."



          The family says Judge Darnell did not say the words, "I'm sorry," but he was emotional and told them he would help them investigate what went wrong in Cole's case so the same thing won't happen again in the future.
