A local district judge is under fire and stands accused of favoritism.

Jared Darnell, the son of district Judge Jim Bob Darnell, was charged with driving under the influence in July of 2008.  Jared Darnell was neither arrested at the scene nor arrested later.

The District Attorney's office diverted Jared Darnell into a pre-trial intervention program instead.  The warrant for jared darnell's arrest was never served.  And his DWI charge was dismissed on November 3rd.

Now defense attorney Rod Hobson is asking why.

"People have to believe that our system is fair and doesn't favor the rich or the wealthy or the powerful or the well-connected over everybody else," Hobson said.

A hearing is scheduled for Wednesday morning to decide whether or not Judge Darnell will recuse himself from an upcoming case.
