New Trial Preparations Underway for Callie Long

A new trial is set to start in the case of Callie Long, the Lubbock realtor convicted of manslaughter.


Long's attorney and the prosecuting attorney were at the Lubbock County Courthouse Wednesday morning.  The prosecution was asking for evidence to be returned and for an appointed investigator to find witnesses.

           

You may remember Callie Long was convicted of intoxicated manslaughter in 2005, after hitting 29 year old Brett Walrath two years earlier.  Long's attorney asked for an appeal and an appellate judge granted that request.  That judge said a jury never convicted her of a DWI, so they couldn't legally determine whether intoxication was a factor in the incident. 


A trail date is tentatively set for February 25th.
