Rodriguez Back in Lubbock

Accused suitcase killer Rosendo Rodriguez was back in Lubbock Tuesday afternoon for a pretrial hearing.

For the past several weeks he has been awaiting trail in Randall County for the beating death of Summer Baldwin and her unborn child.

On Friday, court officials announced they found fourteen men and women who will determine the Rodriguez's fate.

District Attorney Matt Powell is seeking the death penalty.

During Tuesday's pretrial hearing, the defense withdrew two motions to suppress comments that Rodriguez made, one in 2005 and another in 2006.

The defense originally cited ineffective counsel as reason for those comments.

The defense withdrew the motion because Powell would then be able to call member of the original defense team to testify, thus nullifying

attorney-client privilege, meaning anything Rodriguez said to those attorneys would be fair game.

The capital murder trial begins Monday in Randall County.
