Second Capital Murder Trial of 2008 Begins

The capital murder trial for Darold Simmons began today.
The 20-year-old is accused of robbing and stabbing an elderly man to death.
Witnesses described 72 year-old Ross Mosley as generous, happy-go-lucky, and a lot of fun.
They say he loved playing Texas Hold 'Em and drinking gin with his friends, but in February of last year he ran into Darold Simmons on his way home.
Police found Mosley face down a stranger's front yard on the 1900 block of East Cornell.
He had been stabbed to death in the chest.
Just about an hour later, around 8 a.m. a Lubbock police officer caught 19 year-old Darold Simmons sexually assaulting a female cab driver.
He arrested Simmons, but had no idea he was involved in Mosley's murder.
Police soon found evidence linking him to the crime.
Monday afternoon, detectives, friends of the victim and his stepdaughter took the stand, and they began piecing together what happened that morning.
Simmons's defense attorney didn't give much away during opening arguments, but he said what happened early that February morning was a sad chain of events, and a tragedy of both sides.
