By: Amy Montalvo
Updated: June 13, 2008
Convicted killer Rosendo Rodriguez is back in Lubbock after sitting on death row for only one month. The convicted Suitcase Killer is awaiting a motion for a new trial. Rodriguez was convicted in April of capital murder for the rape and murder of Summer Baldwin. Hes also been implicated in the murder of Lubbock teen Joanna Rogers. Assistant District Attorney Tray Payne says this is all part of the standard appeals procedure. "The motion for a new trial does not surpise us in any way. Do we think it will be granted? No. Our goal when we started the process was to send him to death row because we thought that was justice. I dont know what the time frame will be, but we hope 10 to 15 years from now jusitce will have been served." Rodriguez will wait in the Lubbock County jail until after his hearing on June 19th.
