ROSENDOpkg.transfer2008-06-19-1213935126.jpgAttorneys for convicted suitcase killer Rosendo Rodriguez asked a Lubbock judge for a new trial on Friday. They say Rodriguezs original attorney was ineffective. That orginal attorney, Alberto Rodriguez, took the stand this afternoon.. The appellate attorneys say Mr. Rodriguez never should have allowed the defendant to give a videotaped statement to police, in which he described killing Summer Baldwin in self defense, especially before seeing the compltete autospy results, that clearly showed Summer Balwdin had been beaten to death. Now, Mr. Rodriguez replied by saying that his client had been "very convincing" and hed believed him all along. He says thats the reason he wanted rosendo to give that self-defense statement, so that the self-defense claim would go on record immediately.
