Scott Scarborough picked up his dog Five from the Lubbock Animal Services last week, and when he first tried to pick up Five, Animal Services said no.

"I went to pick him up and they said you have to spay or neuter him, and I said 'No, I'm not going to do that,'" said Scarborough. "So they said he had to stay."

Scarborough was able to get his dog out, but only after agreeing to a fine and a ticket for failing to neuter his dog.

He was fined under the city ordinance that states any dog that has been picked up twice, and is not already spayed or neutered, has 30 days from the date of the pickup to be spayed or neutered.

This ordinance is done to keep overpopulation in the city down.

Scarborough said he understands the reasoning behind the ordinance, but wishes there was another option other than neuter or put down his dog.  He hasn't neutered his dog yet because he wants to breed his dog.

"I get the rules, I get it, I don't fault them for it, I just wish there was some middle ground," said Scarborough.

Scarborough said he does have a date set for Five's neutering, but really would like to breed him at least once before he has that done.
