Texas Law Makes Stealing Metal a Felony

The Bill makes it a felony to steal metal so technically a person could be charged with a felony for stealing a penny.

Texas resident John Winker said he doesn't think the law will be enforced.

"Well I don't steal copper anyway but yeah I'll pick up a penny. They're not going to enforce that."

The Lubbock District Attorney's Office isn't going to pursue any charge either. Assistant District Attorney Wade Jackson said they will be looking at the intent of the law.

"We understand that the intent of this law is to stop stealing metals from construction sites. I know that stealing the copper wiring off pivots for farmers is a very big thing. That is what we are more interested in is if they are stealing copper wire, brass fittings, those types of things that stops construction."

State Representative Tim Kleinschmidt has filed a bill to make the minimum amount for a felony-grade metal theft in Texas 500 dollars eliminating the chance of becoming a felon for taking a penny.
