Former Hockley County Sheriff David Kinney is back to court today for day two of his hearing. Kinney expected to hear a decision on whether or not he can be re-instated as Sheriff, as well as have the temporary restraining order against him from the county dropped.
You'll remember Kinney was removed from office back in August, after two members of his staff were indicted on federal drug charges.
The judge saying today though, he didn't have the power to re-instate him. However, he did drop the temporary restraining order. That ruling causing some confusion for both attorneys involved in the case.
Rod Hobson, Kinney's Attorney: "Both Mr. Dennis and I were apparently under the impression that he could reinstate him, the judge says the statute does not allow for that."
A full jury trial will begin March 22nd.
