In April of 2006, Juan Nunez III was tasered by Lubbock Police Officer Matt Doherty.

Doherty said Nunez was drunk and belligerent. But what was supposed to subdue Nunez lead to his death.

A combination of alcohol, the shock and falling and hitting his head killed him according to medical examiners.

The Nunez family has since filed suit against Doherty and the City of Lubbock.

According to court documents, Chief Claude Jones is said to have destroyed a document instructing taser instructors not to talk to the media.

The deposition comes from Internal Affairs Sgt. Tony Gribbin.

The Nunez family is now making a motion for spoliation.

They feel the document may have been crucial to the case and the jury should know that it was destroyed.

Jones said the document had no baring on the Nunez case, but the family says since it was destroyed, they will never know.

If the jury is notified that a possibley sognificant document was destroyed, this could hurt the City of Lubbock when it comes time for judgement.
