The suitcase killer has submitted a motion for a new trial.

In April, Rodriguez was sentenced to death for the rape and murder of Summer Baldwin.

He's also been implicated in the murder of Lubbock teen, Joanna Rogers.

The district attorney's office says this is all part of the standard appeals procedure.

"The motion for a new trial does not surprise us in anyway," said Tray Payne, an assistant district attorney.

"Do we think it will be granted? No."

Rodriguez's hearing is scheduled for Thursday, June 19th.
